St. Pete Beach Board of Adjustment Approves Dock Expansion Despite Neighbor Opposition
- Meeting Overview:
The St. Pete Beach Board of Adjustment meeting focused on several variance requests, with particular attention given to a contentious dock expansion proposal on East Vina Delmare Boulevard. Despite opposition from a neighboring property owner, the Board approved the expansion, citing the applicant’s need for improved accessibility due to mobility limitations. Other topics covered at the meeting included generator installation variances for residential properties and design amendments for a multifamily building.
The dock expansion request involved reconstructing and enlarging an existing dock on East Vina Delmare Boulevard. Representatives for the applicant, Micah Thompson and Shannon Lemus from Golf and Bay Dock Works LLC, sought permission to increase the dock’s width to 24 feet and its length to 15 feet, extending between 77 and 92 feet from the seawall. While the northern neighbor consented to the expansion, the southern neighbor opposed it, necessitating the Board’s intervention.
Micah Thompson stated, “The biggest reason we’re applying for this variance… is that here is the boat and then this gentleman is in a wheelchair full-time.” Thompson emphasized that the proposed dock width would facilitate easier boarding, which was vital for the applicant’s mobility needs.
During public comments, southern neighbor Russ Benson expressed concerns about the dock expansion’s potential impact on navigability and safety. Benson recounted incidents of boats grounding and colliding with his property, highlighting the waterway’s challenging conditions due to waves, currents, and wind. He argued, “I have had boats repeatedly grounded… I sent a sample of a boat shining lights in my residence. I’ve had boats hit my dock.” Benson maintained that the dock’s expansion would exacerbate these issues and worsen navigational challenges.
Despite these objections, the Board approved the variance, concluding the applicant demonstrated sufficient hardship related to accessibility needs. The Board noted the applicant’s willingness to adhere to the square footage limits and the lack of intent to increase boat traffic. A motion to approve the variance carried in favor of the dock expansion.
In addition to the dock expansion, the Board addressed several cases involving generator installation variances in residential areas. One notable case was a variance request for a generator installation at 2921 21st Avenue. The applicant sought to place the generator within the required side yard setback. The variance was necessary because the proposed location would encroach by three feet into the setback area mandated by the land development code.
During the discussion, members highlighted the importance of generators for storm preparedness and resilience. The applicant’s representative argued that alternative locations for the generator were either non-compliant with safety regulations or would detract from property aesthetics. The Board unanimously approved the variance, emphasizing the need for homeowners to enhance their properties’ resilience against storms.
Another generator variance case concerned a property on East Vina Delmare Boulevard. The applicant sought a similar variance for an elevated generator, citing the necessity for compliance with updated codes regarding setbacks. The applicant’s representative detailed considerations for noise levels and safety regulations, addressing concerns about the generator’s placement and its impact on neighboring properties.
In addressing these generator variance cases, the Board recognized the trend of residents seeking to improve their homes for increased safety and resilience. Members expressed the need for consistency in approving variances given similar circumstances, emphasizing the significance of life safety concerns tied to generator installations.
The meeting also included a discussion on design amendments for a multifamily building located at the northwest corner of G Boulevard and 37th Avenue. The applicant requested modifications to the facade design, transitioning from a townhome to a condominium development. The Board approved these amendments, acknowledging improvements in character and presentation while ensuring compliance with zoning regulations.
