Summit City Zoning Board Approves Patio Expansion Despite Zoning Variances

The plan included reconstructing and expanding the rear patio, which had been built without prior approval. The expansion would add approximately four feet to the patio’s dimensions and alter its shape from circular to square. To support the new layout, a boulder wall was proposed, with a maximum height of 3.85 feet, to stabilize the terrain and manage stormwater runoff effectively.
The board’s deliberations centered around ensuring that the proposed changes adhered to municipal regulations and adequately addressed stormwater management, especially given the property’s steep slopes. Expert testimony confirmed the existence of a drywell system designed to handle additional runoff from the expanded patio and previous property developments. The inclusion of a trench drain at the patio’s end was highlighted as a measure to direct flow to the drywell system.
Additionally, the representatives sought variances for the patio’s side yard setback and steep slope disturbance, citing the lot’s challenging topography. A proposed setback of 12.7 feet fell short of the required 17 feet, justified by the need to utilize the existing slope effectively without encroaching further into the rear yard. The steep slope disturbance exceeded allowable limits but was deemed necessary to mitigate erosion and improve stormwater management for neighboring properties.
The applicant’s representatives assured the board that the improvements would enhance stormwater management, contribute positively to the community, and align with zoning ordinances and municipal development plans.
As the meeting progressed, the board heard another case involving a proposed deck and front improvements on Hughes Place. Homeowners Brendan and Michelle Reese, who had undertaken renovations since purchasing the property in 2021, sought to integrate their outdoor space more effectively with their home. The proposal, presented by architect Joseé J. Janiro, involved adding a deck to provide direct access from the second level to the backyard, addressing accessibility issues. The new deck would result in a lot coverage increase from 18% to 22.67%, exceeding the maximum allowed 20%. Despite this, the board found the proposal reasonable, given the property’s existing drainage capabilities and the homeowners’ openness to implementing additional stormwater measures if required.
The board also discussed a variance request for a residence on Tulip Street, where the homeowners proposed a second-floor expansion over the existing kitchen and sunroom. The expansion required a D4 variance for floor area ratio (FAR), exceeding the permitted 35% by 130 square feet. Despite the increase, the board recognized the project’s minimal impact on the neighborhood’s overall appearance and the architectural efforts to maintain harmony with existing structures.
In closing discussions, the board emphasized the importance of maintaining neighborhood aesthetics while accommodating modern living needs. They expressed appreciation for the applicants’ efforts to preserve historical characteristics in their renovations and expansions, particularly in neighborhoods lacking formal historic protections. The board approved the applications.
