Summit Zoning Board Postpones Key Cases Due to Incomplete Board
- Meeting Overview:
In a recent meeting of the Summit City Zoning Board, chaired by Joseph Steiner, the board postponed decisions on two significant cases due to an incomplete board, which fell short of the required number to vote on D variance requests. The cases of Thomas John’s Holding and Morris Avenue were each deferred to future dates, with the applicants’ consent to waive the board’s time to act.
The meeting began with a recognition that the board had a less than full attendance, with only six members present, one short of the number required to vote on the D variance requests. Both Thomas John’s Holding and the case on Morris Avenue involved such variances, which necessitated five affirmative votes for approval. Due to the absence of a full board, the applicants were granted the opportunity to reschedule their presentations to ensure the presence of a complete board, thereby maximizing their chances for approval.
For Thomas John’s Holding, the applicant’s attorney, Hillary S from Dempsey Dempsey and Shen, requested to carry the application to June 18th without further notice, which the board approved. Similarly, the case on Morris Avenue was moved to July 15th, with the applicant also waiving the board’s time to act.
The discussions during the meeting shed light on the processes and regulations governing the board’s actions, including the explanation of members’ rights to present in front of a full board and the provisions regarding the timeframe within which the board must act on applications. The motion to carry both cases was passed unanimously by the members present.
In addition to case postponements, the Zoning Board addressed several resolutions, approving minutes from the April 1st, 2024, meeting, and discussing the ongoing preparation of the annual report. The report’s completion has been delayed, with additional comments and edits still to be incorporated. It was concluded that the report would be reviewed again and possibly approved at the second meeting in May.
