Titusville Board Denies Variance for Large Accessory Structure, Approves Car Wash Buffer Change
- Meeting Overview:
In a recent meeting, the Titusville Board of Adjustments addressed two significant variance requests: a proposal to exceed accessory structure size limits on Mockingbird Lane and a request to eliminate a masonry screening wall for a new car wash on Cheney Highway. The board ultimately denied the former and approved the latter, reflecting careful consideration of zoning regulations and property owner needs.
The primary focus of the meeting was the variance request concerning a property on Mockingbird Lane. The applicant sought permission to construct a large accessory structure, exceeding the allowable size of 50% of the principal building’s square footage. The existing rules cap additional structures at 430 square feet, but the applicant proposed a detached building of 1,470 square feet, resulting in a total of 1,518 square feet for accessory structures, or 176% of the main house’s size.
Staff recommended denial of the variance, citing no unique conditions that would justify such an exception. They emphasized that the property’s size and layout could accommodate a compliant structure. During public comments, Glenn Keller, a resident of Mockingbird Lane, voiced his concerns about the limited driveway access and the need for a secure space to protect his vehicles and RV. Keller highlighted past thefts, including a $15,000 tool loss, and shared letters from neighbors supporting his proposal.
The board explored the potential for alternative solutions but adhered to the zoning rules, which state non-conforming structures cannot expand without a variance. A motion to approve the request was made but failed to secure the necessary four-member majority, resulting in the variance’s denial.
Attention then turned to a variance request for a car wash on Cheney Highway, which sought to remove the requirement for a six-foot masonry wall adjacent to residential zoning. The attorney for the applicant argued that the natural tree canopy and wetlands on the adjacent lot provided sufficient screening. Photographs included in the agenda illustrated the existing natural buffer, supporting the claim that a wall would be redundant and potentially harmful to the preserved environment.
The board engaged in a thorough discussion about the future of the adjacent lot and the permanence of its natural state. The attorney assured that any future changes would require board review, offering reassurance about the preservation of the tree canopy. The board unanimously approved the request, allowing the car wash to proceed without the masonry wall, recognizing the natural features as adequate buffers.
