Treasure Island Commission Faces Legal Shakeup Amidst Drainage and Variance Debates
- Meeting Overview:
During a recent Treasure Island City Commission meeting, discussions centered on the potential termination of the city attorney’s services, drainage plan complications, and a controversial variance request.
The commission meeting turned contentious when a motion to terminate the services of the Sabatini law firm as city attorney was introduced. Concerns were raised regarding the attorney’s performance, including missed contractual obligations and unprofessional conduct, such as tardiness and unreliable legal advice. This dissatisfaction led to a proposal for a request for proposals (RFP) to find a new city attorney, emphasizing the necessity for competent legal representation to maintain public trust and effectively manage ongoing projects. The urgency of the matter was debated, with some commissioners questioning the appropriateness of addressing this issue during an emergency meeting. Nonetheless, a vote was taken, resulting in a split decision, highlighting the division within the commission on how to proceed.
Parallel to the legal discussions, the commission addressed ongoing frustrations with the Treasure Island Manual (TMM) and its impact on the permitting process. A 60-day emergency ordinance was proposed to expedite the process while the commission works on simplifying existing regulations. The ordinance aims to repeal sections of the terrain modification manual, allowing for emergency relief from requirements related to drainage plans. This measure seeks to address the backlog of permit applications caused by the failing seawalls and other complications, providing immediate relief to residents and builders.
Public comments underscored the community’s discontent with the current drainage regulations and the permitting backlog. Residents and contractors expressed their frustrations, citing delays and the convoluted nature of the TMM process. Concerns about the role of third-party engineers were also raised, with many attributing delays to their involvement. Suggestions were made to handle engineering reviews in-house to streamline processes and reduce costs. The Public Works Director assured the commission of the department’s capability to manage drainage plan reviews internally, advocating for collaboration to develop efficient solutions.
Amid these broader discussions, the commission also considered a variance request for a staircase encroachment on Seventh Street. The applicant, facing significant hurricane damage, sought approval for an eight-foot-wide set of stairs that would encroach into the front yard setback. The board was divided on the matter, with some members expressing reluctance to grant variances that could alter the neighborhood’s character. However, after detailed deliberations, a motion to approve the variance was passed with a 5-2 vote. The approval was limited strictly to the staircase.
The meeting also touched on the complexities of easement and setback regulations, particularly the implications of a 100-foot right-of-way on Seventh Street. Residents raised concerns about the fairness and practicality of such expansive right-of-ways, questioning whether they were necessary for residential areas.
