Upper Town Council Considers Cannabis Business Expansion and Noise Regulations
- Meeting Overview:
In a recent Upper Town Council meeting, the most discussions centered on the potential expansion of regulated cannabis businesses and the revision of noise and construction regulations. A local resident advocated for allowing cannabis businesses, while council members debated the nuances of noise ordinances and construction hours.
Spencer Bells, a lifelong resident, voiced his support for expanding regulated cannabis businesses. Drawing on his industry experience, Bells highlighted the benefits of cannabis sales in New Jersey, such as increased tax revenue, job creation, and economic diversification. He urged the council to consider permitting one cannabis retailer and several cultivators and manufacturers to improve local funding and support schools. Bells’ comments underscored a growing interest in diversifying Upper Township’s economy through cannabis, an issue that has gained traction in many municipalities across the state.
Meanwhile, the council discussed proposals to amend existing noise ordinances. A member noted differing regulations in nearby towns, such as Ocean City’s quiet hours from 10 p.m. to 8 a.m., which align with Upper Township’s proposed standards. However, opinions varied on whether to set quiet hours starting at 9 p.m. or 10 p.m. The council noted the New Jersey campground code’s 11 p.m. quiet hours, deemed unsuitable for a resort community. The council aimed to balance residents’ comfort with economic activity, reflecting ongoing debates in similar communities.
The council also considered revising construction regulations, particularly in high-density residential and commercial zones. Current rules permit weekend construction, but concerns were raised about its impact on residents, especially during peak seasons. The council debated a potential ban on weekend and holiday construction, with exceptions for emergencies. Some members suggested prohibiting Sunday and holiday work while allowing Saturday construction, mindful of property turnover challenges.
Further discussions touched on aligning construction hours with the landscaping ordinance to establish a uniform timeframe. The council expressed concerns about construction noise and vehicle parking issues, especially on Saturdays. There was a consensus on the need for a balanced approach to maintain the community’s resort character while accommodating necessary development.
The meeting also addressed financial matters, including a recommendation to allocate $29,000 to the loss contingency fund due to pending litigation. The council reached a verbal agreement on a $125,000 litigation settlement, emphasizing the importance of diligence with financial resources.
In terms of ordinances, the council adopted ordinance number 7.25, increasing fees for residential lead inspections to prevent township costs. They also adopted ordinance number 8.25, abolishing the zoning board of adjustment and transferring powers to the planning board, following a recommendation from the planning board. Ordinance number 10.25, introduced for a December 8 public hearing, proposed shifting application and escrow fees to applicants and included provisions for speed hump consideration.
Ordinance number 11.25 authorized land sales to the New Jersey Department of Transportation for improvements at a specific location, with additional clarity needed on subdivision requirements. The council also received notification of a dividend from the GIF, with discussions on its allocation.
The meeting concluded with plans for upcoming events, including a Veterans Day ceremony, Community Night, and the holiday tree lighting. The council expressed enthusiasm for these events, reflecting on their significance for the community. Additionally, a shared services agreement with the Woodbine Court system was approved to address revenue loss from losing Dennis Township, effective January 2026.
