Upper Town Council Considers New Noise Ordinance to Balance Resident Peace and Business Needs
- Meeting Overview:
The Upper Town Council meeting recently focused on addressing critical local issues, notably the proposed amendments to the noise ordinance and the introduction of a new ordinance concerning bulkhead inspections.
The discussion on the noise ordinance was central to the meeting, as council members weighed amendments to existing regulations in response to community feedback. The proposed changes suggest that outdoor music at bars and restaurants should cease by 9 p.m., unless it qualifies as “soft music,” which can continue until 11 p.m. Public venues, such as Excursion Park, are allowed to extend music until 11 p.m. The term “soft music” raised questions, prompting some to seek clarity on acceptable sound levels. Concerns were also raised about the ordinance’s enforcement, especially given ongoing litigation involving a restaurant in Summers Point that had extended its music hours, leading to disputes.
The council members deliberated over the proposed 9 p.m. cutoff, examining ordinances from nearby municipalities like Middle Township to ensure fairness and standardization across Upper Township. Some members advocated for revisiting the ordinance to ensure it aligns with community standards while considering business interests. Comparisons were made with other towns, such as Summers Point, which permits music until later, creating a potential conflict with Upper Township’s proposal.
Public comments on this topic highlighted a resident’s concern over the proposed ordinance’s enforcement, citing challenges in reporting issues. The resident expressed frustration with being redirected from the township to the county and then to the state police, emphasizing the need for a straightforward process for residents to address concerns effectively.
In tandem with the noise ordinance, the council introduced Ordinance Number 9, 2025, which proposes shifting inspection costs for bulkhead construction from the municipality to developers. This change follows the township’s transition from employing a municipal engineer to utilizing a consulting firm for engineering needs. The ordinance aims to align Upper Township’s practices with neighboring municipalities that employ similar consulting arrangements. The shift in financial responsibility was noted as a significant modification, and the public hearing for this ordinance is scheduled for November 24th.
Additionally, the meeting addressed community concerns related to parking regulations. A resident voiced frustration over potential fees for boat storage, drawing comparisons between restrictions on boat parking and allowances for unregistered vehicles in driveways. This resident, emphasizing their tax contributions, questioned the rationale behind viewing boats as greater eyesores than unregistered vehicles.
Mayor Curtis T. Corson, Jr. discussed recent efforts to address this issue, including a walk on the Stratmir beaches with local officials and conversations with Congressman Andrew and a senator about potential solutions. Efforts to work with the Army Corps of Engineers and the EPA were also noted to streamline processes and reduce bureaucratic hurdles.
The council emphasized the importance of early voting, which had begun at the Upper Township Library and county libraries. The mayor thanked John Britain from EMS and others for their contributions to a successful local trunk-or-treat event, which distributed 900 pieces of candy to trick-or-treaters.
