Westport Conservation Commission Approves Dock Proposal Amid Environmental Concerns

Another agenda item involved the septic system repair request from Harold Trip Jr. on Main Road. The existing system, installed in 1976, had failed, necessitating a new installation designed by Westport Environmental Design. The system was positioned 55 feet from the nearest wetland boundary, with erosion controls planned to mitigate environmental impact. Following confirmation of wetland flag delineations and Board of Health approval, the Commission voted unanimously in favor of a negative box 3 determination, allowing the project to proceed.
In a separate matter, the Commission deliberated on a request for determination of applicability concerning Derek Ogles’ property at 231B Tickle Road. Ogles had constructed retaining walls and conducted grading within the buffer zone to South Tupper Pond without prior approvals, prompted by neighbor complaints. Patricia Lehei, a neighbor, voiced concerns over obstructed water access due to the retaining walls. Despite acknowledging the civil nature of access disputes, the Commission deemed Ogles’ work compliant with the Wetland Protection Act.
The meeting also included administrative approvals for a three-year extension of beach nourishment activities at the Westport Yacht Club. The extension, associated with file number SE2687, involved adding sand to the “baby beach” area above mean high water, subject to compliance with the Wetlands Protection Act. Questions about sand sourcing were raised, particularly avoiding fine “sugar sand” that could lead to sedimentation issues. The extension was approved without opposition.
Attention was further directed to the Adamsville Dam, where recent site visits had assessed fish ladder adjustments and water level management. The Commission discussed the installation of new boards to maintain appropriate water levels during the herring migration season. Concerns were raised about prior actions by the dam owner that allegedly involved dismantling parts of the dam, potentially motivated by unrelated business permits. A memorandum of understanding was proposed to formalize the owner’s obligations to prevent future discrepancies in water management.
The meeting concluded with the approval of a certificate of compliance reissuance for State Road Auto Sales and the authorization of financial expenditures for office supplies and a cell phone bill. Additionally, a planned site visit for the Bisco property on Main Road was announced.
