The project included plans for a septic system, well, driveway, grading, and drainage system on a lot adjacent to the parents’ property. Despite the Board of Health’s approval of the septic system and stormwater controls, the project faced scrutiny due to concerns about the area’s wetland conditions. A member voiced opposition, highlighting ongoing complaints from residents about wetness and runoff in the area. This led to a split vote, with one member opposed to issuing a negative box four determination for the project.
Another discussion involved 735 Sodom Road, where a proposal to replace a failed retaining wall with a modified rock slope was considered. The existing wall had been compromised by water infiltration, prompting a recommendation from a structural engineer to install a stone riprap slope with geotextile fabric to prevent erosion. Members raised concerns about the original management of runoff, particularly the improper direction of water from roof gutters, which had exacerbated erosion issues. A proposal was made to condition the project’s approval on the homeowner diverting roof runoff away from the area before reconstruction could begin. This discussion highlighted the importance of rigorous controls on drainage and runoff management to mitigate future problems.
The commission also addressed stormwater management, with a decision to involve Chris, a presumed staff member or consultant, in overseeing stormwater redirection efforts. The commission’s consensus was that any changes to stormwater flows should receive Chris’s approval.
In addition to these discussions, the commission considered several requests for certificates of compliance. BGO Solar sought approval for a solar array on Pine Hill Road, which Chris confirmed complied with all approved plans. Despite some dissent regarding the environmental impact of solar projects, the commission issued the certificate with a majority vote. A similar request for a property on K Way was also approved, resolving an old order of conditions dating back to 2004.
The commission granted a three-year extension for a coastal berm project on West Beach Road, reflecting unanimous support for maintaining the structure. Routine administrative approvals were also addressed, including expenses for office supplies and mileage reimbursement for Chris Capone.
A significant enforcement issue arose concerning unauthorized clearing activities by property owners on Sodom Road. The clearing extended beyond the limits set by a previously installed split rail fence, encroaching upon a nearby wetland and no-activity zone. Chris advocated for immediate regulatory enforcement and suggested sending an enforcement order to the property owners to cease activities and ensure compliance. The commission agreed to take action, highlighting frustrations over the apparent lack of communication from developers and legal representatives regarding regulatory limits.
