Kudo also raised concerns that sidewalks could inadvertently increase traffic speeds, posing risks to pedestrians, especially children.
Support for Kudo’s stance came from Robert KFI, the developer of Bentley Estates 2, who expressed agreement with the homeowners’ request. He urged the board to respect the collective wish of the residents by eliminating the sidewalk requirement. KFI pointed out that phase one of the development lacked sidewalks, which had not been an issue for residents at the time. The dialogue underscored the residents’ desire for consistency with the first phase of the development.
However, not all board members were convinced by the homeowners’ arguments. A board member highlighted the importance of adhering to the original development agreement, which included sidewalks. The member emphasized that failing to enforce such regulations could set a precedent allowing future developers to ignore binding agreements. The debate centered on the necessity of sidewalks for public safety and accessibility, particularly for individuals with disabilities.
Residents of Bentley Lane, including Emanuel Bello and Cesar Franco, echoed concerns about the potential drawbacks of sidewalk installation. Bello argued that reducing the road width to accommodate sidewalks could create safety hazards, while Franco insisted that the choice regarding sidewalks should rest with the residents. These views highlighted the ongoing tension between maintaining community character and adhering to regulations.
The meeting also featured a public hearing about a request for a waiver of sidewalk installation for the Little Compton Housing Trust’s proposed development. The discussion revealed complexities in approving developments that straddle municipal boundaries, as the proposed right-of-way would need to meet Westport’s standards despite primarily serving properties in Little Compton. This topic illustrated the challenges of jurisdiction and compliance with local regulations.
In addition to the sidewalk debate, the board addressed updates on the town’s short-term rental regulations, including a self-certification process allowing rentals in all zoning districts with certification from the building department and licensing from the select board. The Hazard Mitigation Plan was also discussed, with a public engagement session planned to invite community input.
The meeting further included a planner’s report outlining expressions of interest submitted to the Municipal Vulnerability Preparedness Program. These expressions aimed to aid the Climate Resilience Committee and develop a townwide stormwater plan, emphasizing nature-based solutions and prioritizing critical areas affecting first responders.
