Winona County Board Approves Variance for Home Construction Near Feedlot
- Meeting Overview:
The Winona County Board of Adjustment recently granted a variance allowing a single-family dwelling to be constructed 770 feet from a registered feedlot, despite the standard requirement of a 1,000-foot setback. The decision, which involved extensive discussion of environmental and regulatory implications, included conditions for erosion control and received support from the local township.
The primary focus of the meeting was a variance request to construct a new home in Saratoga Township, which required proximity to a feedlot registered for cattle but measuring setbacks from a horse barn. Petitioners Chris Roth and his wife Elsa detailed their plans, which included discontinuing living quarters in an existing structure known as a “shouse” once the new home was built. This variance request follows earlier permissions granted for the shouse, which combines a shop and temporary living space.
The board considered the petition with input from the township, which supported the variance based on previous agreements. Concerns about erosion and water runoff were central to the discussion. The petitioners described the property’s topography, noting a 7% slope and issues with water flowing through a valley. A local dyke pond, reportedly filled over time, has contributed to erosion on neighboring land. The petitioners expressed willingness to address these concerns, with board members emphasizing the need for a comprehensive erosion control plan to be reviewed by the county’s Soil and Water Conservation District.
Discussion extended to the driveway and septic system designs, tailored to accommodate a five-bedroom home. Questions about future use of the shop were raised, with the petitioners clarifying it would remain a family gathering space and not be rented out. Additionally, the petitioners addressed concerns about farm-related odors and dust from agricultural equipment, emphasizing their comfort with the environment due to their agricultural background.
The variance also raised the potential for the neighboring feedlot operation to expand closer to the new dwelling, heightening concerns over future agricultural activities. Olivia, presumably representing the board, clarified that any expansion of the feedlot would still necessitate a separate variance application.
During public comments, support for the petitioners was voiced. Letters from other landowners expressing concerns about agricultural land loss were reviewed, but board members noted discrepancies between the letters and observable conditions.
Ultimately, the board voted unanimously to approve the variance, contingent on the development and implementation of an erosion and sediment control plan to mitigate environmental impacts.
