Winona County Planning Commission Approves Variances for Streamside Dwelling, Discusses Land Use Changes
- Meeting Overview:
The Winona County Planning Commission meeting focused on significant land use deliberations, including the approval of variances for a dwelling near a stream, a conditional use permit for a new dwelling in an agricultural district, and discussions on existing parcels transitioning from farm help to residential status. The commission addressed zoning and environmental considerations while ensuring community engagement and compliance with local regulations.
The meeting began with the Board of Adjustment segment, highlighting a notable decision to grant two variances for a building’s use, allowing the addition of a dwelling unit within an existing structure in Lanes Valley. The building’s proximity to a stream, at about 65 feet, was notably less than the required 100-foot setback. This matter drew various comments and was ultimately approved by a 3 to 1 vote, emphasizing the board’s willingness to accommodate the enhanced use of existing properties despite environmental concerns.
The commission then tackled a petition from property owners Todd and Sheila Waymiller and petitioners Mike and Maryland Kendhammer, seeking a conditional/interim use permit for a new dwelling in a shoreline overlay and agricultural resource conservation zoning district. The property, located in New Hartford Township, comprised two parcels totaling 232 acres. The proposed dwelling, to be situated within an existing structure originally for agricultural use, required careful consideration due to its location within the shoreline overlay district.
Concerns about soil erosion were mitigated by measures taken to stabilize the site and clean the riparian zone of debris, with the Department of Natural Resources expressing minimal concern. The New Hartford Township offered no objections, and the staff analysis favored granting the permit, recommending three conditions for consideration. This petition illustrated the commission’s role in balancing development interests with zoning regulations and environmental preservation.
Another topic was the petition by CMDM Winona LLC, presented by Trevor Klssky of High Point Land Company. The request involved legally dividing an existing modular home and detached garage into a standalone parcel in Richmond Township. The proposal did not involve new construction but aimed to formalize the site for residential use. The commission examined the implications for local tax revenue, topography, and future construction limitations, particularly concerning septic system requirements and existing setbacks.
The discussion revealed concerns about the potential impact on agricultural operations, such as feedlot expansions, due to the site’s residential designation. However, the consensus leaned towards recommending the permit’s approval, acknowledging the historical use of the site and its compliance with established conditions. This dialogue highlighted the complexities of zoning decisions in areas transitioning from agricultural to residential use.
Further deliberations addressed a property owned by the Lean family, focusing on its conditional use permit for farm help. The property, under new ownership, was in the process of infrastructure upgrades, including a new septic system and well. The conversation explored the implications of changing the dwelling’s designation from farm help to residential, acknowledging the challenges of multiple dwellings on a single farm.
Commissioners discussed whether the conditional use permit would allow the property to remain viable for residential use rather than becoming abandoned.
