Yarmouth Zoning Board Tackles Parking and Setback Variances for New Housing Proposals
- Meeting Overview:
The recent Yarmouth Zoning Board meeting focused on several issues, including a proposal for new housing that sought variances for parking and setbacks, as well as managing the complexities of shared driveways and electrical service modifications. The meeting also addressed the intricacies of modifying existing variances and the implications of changes to residential and commercial property uses.
A significant portion of the meeting was dedicated to deliberating Petition 5149, submitted by Rosanna Nicolus, Trustee of the Ponco Realty Trust, for the development of eight one-bedroom apartments on E 28 South Yarmouth. The applicant sought a special permit for relief from parking requirements, overhead electrical service, and a buffer on the westerly side of the property. The representatives for the applicant emphasized the need for additional parking spaces beyond the standard requirement, proposing sixteen spaces instead of the twelve typically mandated for such a development. This request was aimed at accommodating anticipated demand, including visitor parking, with representatives asserting that, “parking… is not a big ask.”
Additionally, the discussion highlighted the challenges of transitioning electrical services underground. The proposal includes maintaining existing overhead lines until they reach the property pole, where they would be directed underground, addressing concerns about the financial implications of relocating the service entirely underground across Route 28, estimated to exceed $100,000.
The meeting also navigated the complexities of shared driveway usage between the subject property and neighboring properties, a point of confusion in previous meetings. A revised plan was presented, detailing a single curb cut to maintain the necessary travel lane width. The applicant committed to enhancing the area with greenery, stating their responsibility for “greening up… with trees or shrubs.” A neighboring property owner at 807 expressed willingness to collaborate on landscaping efforts, offering to plant up to three-foot-high greenery as a buffer along the shared boundary.
Another crucial matter addressed was a proposal for a new housing project that included one-bedroom apartments. Board members generally supported the project, recognizing the need for such housing in the community, particularly for young families. However, concerns were raised about the implications of shared driveways on safety, especially for families with children, though reassurances were provided that trucks would not be part of the residential operations.
Board members also discussed the landscaping plan, emphasizing the necessity of maintaining a buffer zone between residential units and driveways. One member expressed discomfort with the lack of the usual ten-foot buffer seen in similar developments, advocating for additional tree planting to enhance the visual and physical separation of the properties.
The board further deliberated on the financial and logistical aspects of the overhead electrical service, ultimately approving the special permit with conditions allowing for increased parking spaces, overhead electrical lines to remain while transitioning underground thereafter, and adjusted buffer requirements.
The meeting then turned to a petition concerning a land swap between properties on North Street and North Main Street, intended to resolve a minor encroachment issue. The board approved the special permit for this resolution, recognizing the necessity of addressing the encroachment to prevent complications with property financing due to title issues.
In another petition, the board examined a variance request for a property on Route 6A in Yarmouthport. The applicant sought to modify a decision from 1975 to construct a single-family dwelling, necessitating setback relief. The board agreed to replace the existing variance with a new one, which would better accommodate the residential use of the property, considered more suitable given the local context and past failed commercial proposals.
