Another topic was the proposal for a Caribou Coffee drive-thru at Nielsen’s. The board had previously approved a variance for the drive-thru, and the current proposal involved rezoning affected parcels from R3 to C1A to accommodate the drive-thru’s exit. The planning commission plans to hold a public hearing on November 12 to further deliberate on this matter. Concerns were raised about the drive-thru’s proximity to loading docks, and the county had imposed restrictions to minimize the exit’s width. However, the board noted that the proposed configuration would comply with ordinances and not disrupt traffic patterns. Plans for screening and fencing were included to reduce disturbances from headlights during evening hours. The board unanimously approved setting the public hearing.
The meeting also addressed the Berg Homestead preliminary plat, which proposed creating seven single-family home lots with access to 190th Avenue. The plan involved a Planned Unit Development (PUD) designation and a request to reduce the front yard setback from 25 feet to 20 feet. The board discussed the logistics of the setback adjustment and the developer’s agreement. It was clarified that road improvements would be the developer’s responsibility unless development in the area accelerated. The preliminary plat and PUD overlay were approved with a 4-1 vote, with one board member abstaining due to property ownership concerns.
Attention turned to zoning challenges concerning the Driscoll property. Residents expressed interest in purchasing 16,573 square feet of land from Driscoll Southside Properties, but the land did not meet the minimum requirements for an I2 lot, posing zoning challenges. The board discussed options such as replatting or using a deed restriction to address the issue. While residents preferred rezoning to residential to better integrate with surrounding homes, industrial zoning constraints complicated the matter. Access to the property was also a concern, with current codes potentially prohibiting access from residential to industrial zones. The board decided to table the discussion for further consideration and gather additional zoning regulation information.
Lastly, the board approved an amendment to the conditional use permit concerning the Schuman property, extending the deadline for compliance regarding accessory buildings. The amendment changed the deadline from 30 days post-completion of a new structure to December 31, 2026. With no public comments received on this matter, the board planned to send the recommendation to the City Council.
