Herrera provided photographs of her injuries and cell phone footage of the assault, leading to a request for a clerk magistrate’s hearing at Boston Municipal Court for one count of assault and battery against Palomares.
The board expressed concerns over Club Icon’s handling of the situation. Despite having 15 security personnel on duty, the club’s staff did not call the police. The board questioned this lack of judgment and the cultural resistance within the staff to involve law enforcement. Consequently, the board requested a copy of the club’s rules, policy, and procedures manual to verify that staff are adequately trained and aware of the appropriate protocol for such incidents.
In another case involving CMG1 P Square LLC, doing business as Club Mariel on Post Office Square, an altercation between patrons on October 15th, 2023, resulted in one individual sustaining a laceration to the eye and being transported to a hospital, while another faced assault and battery charges. The club’s representatives, Joe O’Conor and Chad Adams, explained that their security team had intervened and separated the parties before calling the police. However, there was no video footage available due to inadvertent deletion. The board requested an incident report and floor plan for further review after learning about the layout and policies designed to ensure group separation.
The board also addressed incidents at other venues, including Game On Fenway LLC, where a bouncer allegedly assaulted a patron with a flashlight following a disturbance in the downstairs lounge area. Detective Gorman detailed the victim’s injuries, which required three stitches, and the subsequent citation issued to the bar. The board scrutinized the bouncer’s actions and the establishment’s response, emphasizing the need for a thorough investigation.
