Yarmouth Zoning Board Approves Deck Expansion, Tackles Complex Height Regulation Issues
- Meeting Overview:
During the July 10, 2025 meeting of the Yarmouth Zoning Board of Appeals, discussions led to the approval of a special permit for a deck expansion, while deliberations regarding compliance with local height restrictions for residential construction projects highlighted the board’s commitment to adhering to bylaws.
The meeting commenced with the board’s unanimous decision to approve a special permit for the expansion of a deck on Lena Road in West Yarmouth. The applicant sought to increase the deck size and relocate a shed on the property. The board agreed on a condition that any future increase in the deck’s height would necessitate the applicant returning to the board for further relief. This condition aimed to prevent any potential intrusion issues with neighboring properties. The applicant’s related variance applications for the shed and deck were withdrawn following the special permit approval, as they were rendered unnecessary.
A substantial portion of the meeting was dedicated to the board’s examination of a property development proposal concerning height restrictions. The petition involved a project seeking to increase the ridge height of a pre-existing nonconforming structure on Powers Lane. The proposed changes, including raising the building by 2.3 feet to comply with FEMA regulations, were scrutinized for compliance with local zoning bylaws. The board members engaged in discussions about the necessity of adhering to the town’s height limit of 35 feet.
There was concern among board members that the proposed structure was nearing the maximum allowable height, which led to discussions about potential modifications to the design. It was suggested that reducing the structure’s height by approximately one foot could allow the project to proceed under a special permit rather than requiring a variance. The board emphasized the importance of consistency with previous decisions, noting that variances for height had rarely been granted unless justified by specific circumstances.
The petitioner expressed willingness to adjust the design to meet the board’s conditions, acknowledging the need to comply with both flood regulations and height restrictions. The board ultimately approved the special permit with the condition that the height be reduced, emphasizing the importance of maintaining the neighborhood’s character and adhering to established bylaws.
The meeting also addressed a petition from the Grove Street Nominee Trust, which sought a special permit to combine and reconfigure two residential properties to create identical lot sizes. Both properties, located on Grove Street and Vernon Street, currently do not meet the 25,000 square-foot requirement. The attorney representing the trust explained that the reconfiguration would not impact existing structures, which comply with setback requirements. The board agreed with the attorney’s argument that the redivision would not increase the number of non-conforming lots, leading to the approval of the special permit.
The board underscored the importance of balancing regulatory compliance with practical considerations for property owners, all while maintaining the integrity of the town’s zoning laws.
The session concluded with the election of officers for the board, where nominations were made and unanimously approved for the positions of Chairman and Vice Chairman. Additionally, the board expressed appreciation for the service of outgoing board member Jay Fraprie, acknowledging his contributions and leadership.
