Yarmouth Zoning Board Approves Special Permit for Garage Expansion Despite Traffic Concerns

The applicants proposed aesthetic improvements, committing to reside the rear with cedar shingles in a Cape Cod gray color and enhance landscaping with additional trees.
Concerns were voiced regarding the placement of used cars on the property. The Basile brothers clarified that all used vehicles would be kept out of view, parked behind the building, thereby maintaining the focus on their primary business operations. Traffic and access were also discussed, with the applicants noting that customer turnover is swift, resulting in minimal disruption.
In addition to the board’s queries, an anonymous letter opposing the petition was submitted, citing concerns about traffic and neighborhood impact. The board deliberated on the fairness of considering an unsigned opposition, ultimately deciding to proceed with a vote. A motion was made to approve the permit with a condition that any used cars for sale be placed at the rear of the property. This motion passed unanimously.
Another item on the agenda was a petition from Bulgakov and Marina Bulga, seeking a special permit for height increase and a variance for setback relief at 177 CV in South Yarmouth. The proposal led to extensive discussion due to the non-conforming nature of the site, which lacked the required frontage and lot size. Morel Orta, representing the applicants, explained the complications arising from the existing foundation’s deterioration, necessitating a significant rebuild that would elevate the structure to comply with flood zone regulations.
Concerns were raised by an adjacent property owner regarding the structural integrity of a retaining wall, which supported landfill from past renovations. The wall’s condition was described as “crumbling,” leading to apprehensions about the additional weight from the new construction. Although the board acknowledged these concerns, it was clarified that the wall itself was not within their direct jurisdiction. The petitioners expressed willingness to address the wall’s condition, though no binding commitment was made.
Despite the debates over the retaining wall, a motion to approve the special permit without conditions was put forth and passed by a majority, with one dissenting vote due to the absence of conditions addressing the wall. The applicants decided to withdraw their request for a variance, which the board approved without prejudice.
The meeting also featured a petition from Kevin and Julie Dakota to install two batting cages on Midcape Drive. The Dakotas presented plans for indoor batting cages to provide year-round training space. They outlined expected operations and parking arrangements, with board members expressing familiarity and support for the initiative.
