Beach Haven Borough Council Tackles Ebike Laws and Pickleball-Tennis Court Conflicts
- Meeting Overview:
The Beach Haven Borough Council meeting addressed pressing local issues, most notably the impacts of new state laws concerning electric bicycles (ebikes) and a debate over the use of public tennis courts by pickleball players. In addition to these central topics, the council approved funds for a playground and addressed storm response efforts.
A significant portion of the meeting was devoted to the implications of New Jersey’s new state laws regulating ebikes. While these laws have been enacted, there remains a lack of corresponding updates to motor vehicle regulations, creating confusion regarding the registration and operation of ebikes. Key points of concern included the absence of Vehicle Identification Numbers (VINs) for ebikes, which complicates registration processes. Furthermore, the laws stipulate that individuals under 17 must wear helmets and possess a driver’s license to operate an ebike, with 15 being the minimum age for operating any electric apparatus. The council discussed the necessity for insurance companies to adapt their policies to include ebike coverage, acknowledging that some insurers are beginning to offer such products.
Many residents mistakenly believed that local authorities were responsible for ebike regulations, whereas these are state-mandated laws. The council emphasized the supremacy of state legislation and the requirement for all municipalities to comply. Enforcement issues, particularly concerning juvenile infractions, were also discussed. Existing laws allow for issuing tickets for violations, such as operating without a license, though adjustments may be necessary as the new laws are applied. Officers were noted to require reasonable suspicion to intervene with young ebike riders.
Equally contentious was the discussion surrounding tennis courts and the growing tension between tennis and pickleball players. Anne Pascus, a tennis attendant, requested legislation to regulate court use and prohibit pickleball during designated tennis hours, citing incidents involving out-of-town pickleball players disrupting local games. The council acknowledged rising incidents, including damage to property, and debated the necessity of an ordinance to formalize and enforce court usage rules. While some council members were initially hesitant, the need for an ordinance was eventually recognized as a means to empower staff to manage violations. The idea of broader regulations was introduced by a public commenter, suggesting an overarching ordinance to address various recreational activities across borough facilities, potentially easing the enforcement burden on staff.
In addition to these discussions, the council approved funding for a new playground at Nelson. By joining the New Jersey Cooperative Purchasing Alliance, the council can issue purchase orders for playground equipment without a bidding process, as these items are covered under state contracts. The anticipated lead time for equipment is six to eight weeks, with installation planned before the summer.
The council also reviewed the municipality’s response to recent storms, with members expressing gratitude towards public works and emergency management teams for their effective handling of severe weather conditions. The importance of community awareness during power outages was highlighted, particularly for vulnerable individuals such as seniors living alone. Communication gaps with Atlantic Electric during outages prompted suggestions for residents to report directly to the non-emergency police number to ensure proper follow-up and assistance.
