Raritan Zoning Board Delays Key Decisions Due to Insufficient Notices and Conservation Issues
- Meeting Overview:
At the recent Raritan Zoning Board meeting, significant delays were announced in the consideration of two variance applications, primarily due to insufficient notification and complex conservation easement issues. The board decided to reschedule the hearing for a proposed hotel expansion and a residential pool installation due to procedural and regulatory setbacks.
The discussion of the hotel expansion application, represented by Hardik Kumar, was postponed because the applicant’s legal representative failed to provide timely notice. The postal service delay caused by a February blizzard prevented the necessary certified mailings from being sent. Consequently, the board agreed to reschedule the hearing to March 19th, with the requirement that the applicant renotice the public according to proper protocol. The board ensured that the rescheduling allowed ample time before any decision deadlines, with the period for board action extending to June 25th.
Another application, from homeowners Mark and Jennifer Vito, sought variance relief to install a pool within a conservation easement on their property. The board’s discussion revealed that the pool’s proposed location conflicted with a township conservation easement, which prohibits structures. The easement, which benefits the township, requires the applicants to seek modification approval from the township committee before the board can consider the variance. Additionally, the board noted discrepancies in the property survey, where a conservation line had been removed without proper authorization, adding complexity to the application process. The board advised the applicants to resolve these issues, either by adjusting their pool plans or securing approval to amend the easement. An extension until December 31, 2026, was suggested for the application process, with the possibility of dismissal without prejudice if no progress is made by June 30.
