Livingston Town Planning Board Approves Amended Application for 222-Unit Residential Project
- Meeting Overview:
In a recent meeting, the Livingston Town Planning Board approved an amended site plan for a multifamily residential project on South Orange Avenue. The development, run by Camelot Associates LP, comprises 222 units, including 45 affordable housing units, and has undergone modifications to its building footprint and amenities while maintaining the approved number of units.
The most notable discussion centered around the implications of deed restrictions for affordable housing and the architectural changes to the building design. Concerns arose regarding proposed deed restrictions on units designated for the superintendent, with participants debating the practicality and potential complications for future financing. The argument was made that additional restrictions could create unnecessary burdens, with one participant noting, “any deed restrictions that are over and above affordable housing are just going to create an enormous unnecessary… complication.”
The legal implications of deed restrictions were also explored, with references to the case of Aldridge versus Schwarz. Participants discussed whether recording the resolution alongside the deed could suffice in notifying future owners of conditions, with one suggesting, “If you record a copy of the resolution with the deed, that would put future owners on notice.” This idea gained traction as a compromise to ensure transparency and enforceability.
Architectural modifications were another focal point, with adjustments to unit counts and amenities being detailed. The project now includes 222 units, consisting of 48 one-bedroom, 151 two-bedroom, and 24 three-bedroom units. The board discussed the distribution of affordable units and the reduction of one-bedroom dens, noting that the number of affordable units remains consistent.
Amenities such as bike storage, pet wash areas, and emergency generators were reviewed, with an emphasis on safely storing and charging e-bikes under Type 1A construction. Stipulations in lease agreements were proposed to ensure compliance with designated storage areas, a move that the board welcomed. The generator planned for the project will support essential services like elevators and common area lighting but will not extend to individual unit climate control.
Visitor parking and the delineation between resident and visitor spaces were also discussed, prompting questions about signage and barriers to prevent confusion. The project plans direct visitors to lobby and outdoor spaces, avoiding separate visitor parking areas.
The board carefully examined the balance between development and community impact throughout the discussions, posing questions about ADA compliance for handicap parking and the overall effects of the changes on the surrounding area. A motion for approval of the amended application was proposed, with all previously discussed conditions included. The board members expressed general agreement, with one stating, “Seems pretty straightforward. I think it meets all the prior criteria. I don’t see any reason to not approve it.”
