Springfield Zoning Board Approves Pool Variance, Addresses Compliance and Damage Issues
- Meeting Overview:
The Springfield Zoning Board meeting on June 16, 2026, resulted in the approval of a pool and patio variance for a property on Meek Street, while also tackling compliance concerns over vegetation clearance and rebuilding efforts following storm damage. The board considered multiple applications, showing a keen interest in resolving variance requests and ensuring compliance with local ordinances.
The most discussed application at the meeting was for a property on Meek Street, where the owner sought approval for lot coverage and sideyard variances to install a pool and patio. The applicant, Lyn Banses, previously exceeded allowable coverage limits due to unpermitted installations of pavers and a pool. In response to prior feedback, Banses, with the help of engineer Edward S. Deck, submitted a revised proposal. The new plan aimed to address these concerns by reducing total coverage, eliminating some pavers, and maintaining a small area for an outdoor kitchen and a walkway around the pool. During the meeting, Deck presented these changes, emphasizing the improvements over the previous configuration. The board expressed satisfaction with the revisions, noting that they enhanced the property’s condition. A vote was held, and the application was approved with four votes in favor and one against, with no public objections recorded.
Another application involved Eugene Pelos, who sought a variance for an air conditioning unit on Hillside Avenue. The mini-split unit, installed without the proper variance, required rectification due to its placement six feet from the property line on a corner lot. Pelos explained that the contractor chose the location for convenience, but it was technically encroaching upon the sideyard setback. The board clarified the nature of the variance, initially misunderstood as a front yard issue, and approved the application after confirming that the unit operated quietly and did not disturb neighboring properties.
The board also handled a request from Carla Diaz for a variance to install a shed on Little Brook Road. This application sparked discussion due to concerns raised by Union County about potential vegetation clearance onto county property. Ronaldo Diaz clarified that, following the removal of fallen trees by county personnel, they were verbally advised to clean and maintain the area. However, the lack of written confirmation prompted the board to advise the applicant to document communications with the county and provide photographic evidence of compliance. Despite these concerns, the board confirmed that the shed’s placement met setback requirements and encouraged documentation to resolve the county’s issues.
Additionally, the board reviewed an application from La Baraso, who sought to rebuild a garage on Henshaw Avenue after it was destroyed by a fallen tree. The original garage had been non-conforming, and because the damage exceeded 50%, Baraso needed new variances for rebuilding. The board empathized with Baraso’s situation, noting that the garage’s non-conforming status required adherence to current zoning regulations for setbacks and coverage. After discussion, the board unanimously approved the application, recognizing the need for rebuilding after the storm damage.
